4. Legal Bases for Processing
Where applicable law requires a legal basis, we process personal information on one or more of the following bases:
Performance of a contract or steps requested before a contract, including creating an Account or Instant Resume Session, providing AI and resume features, processing purchases, and delivering downloads.
Our legitimate interests or those of another party, including securing and improving the Services, preventing fraud and abuse, supporting users, understanding service performance, maintaining business records, and protecting legal rights, balanced against your rights and reasonable expectations.
Compliance with legal obligations, including tax, accounting, payment, sanctions, regulatory, law-enforcement, and valid legal-process requirements.
Consent, where we specifically request it, such as for certain marketing, cookies, optional processing, or other activities for which consent is required. You may withdraw consent prospectively, subject to applicable law.
Other lawful bases recognized in your jurisdiction, such as protecting vital interests or establishing, exercising, or defending legal claims, where applicable.
5. AI and Automated Processing
When you use AI Services, resume import, resume analysis, AI-assisted chat, or rewrite features, your resume content, uploaded files, job descriptions, profile information, prompts, chat history, instructions, and related context may be processed by our systems and by AI or parsing providers that help deliver those features.
We may retain prompts, messages, AI responses, applied actions, resume snapshots or revisions, and related status information so that conversations can continue, changes can be displayed or reversed where supported, failures can be diagnosed, and the Services can be secured and improved.
We may store usage metadata, such as operation type, provider, model profile, token counts, estimated costs, limits, and failure information, to administer subscriptions and Instant Resume sessions, meter usage, improve reliability, monitor costs, and prevent abuse. Internal cost estimates are operational records and are not a monetary balance owned by the user.
AI outputs should be reviewed by you. Our AI tools assist you with career materials and do not make hiring, employment, credit, housing, insurance, or similarly significant decisions about you on behalf of third parties. If we materially change how private User Content is used for general-purpose model training beyond providing, securing, or improving the requested Services, we will provide additional notice and obtain consent where required by law.
6. How We Disclose Information
With Writers and Job Seekers as needed to facilitate marketplace orders, messages, uploaded references, approvals, revisions, disputes, reviews, and service delivery.
With collaborators you invite, according to the permissions you choose.
With the public when you publish a resume, writer profile, portfolio content, review, or other public information.
With service providers that support hosting, storage, databases, AI processing, resume parsing, image processing, email delivery, analytics, observability, security, payments, payouts, fraud prevention, and customer support.
With payment providers, banks, card networks, and payout providers as needed to process payments, subscriptions, refunds, chargebacks, payouts, and compliance checks.
With law enforcement, regulators, courts, professional advisers, or other parties where we believe disclosure is required by law or necessary to protect rights, safety, security, or platform integrity.
With a buyer, investor, lender, affiliate, or successor in connection with an actual or proposed merger, financing, acquisition, reorganization, sale of assets, insolvency, or transfer of all or part of the Services, subject to appropriate confidentiality and applicable law.
7. Public Content and Analytics
If you publish a resume or writer profile, the published information may be visible to anyone with access to the link and may be indexed, copied, saved, or shared by others. Resume views, downloads, writer profile views, hire clicks, approximate location, referrer, and device information may be used to provide engagement analytics and abuse prevention.
8. Cookies, Analytics, and Similar Technologies
We use essential cookies and similar technologies for Account authentication, Instant Resume session access, security, fraud prevention, preferences, and reliable operation. Blocking essential technologies may prevent parts of the Services from working.
We also use or may use analytics and performance technologies, including third-party analytics services, to understand visits, navigation, device and browser characteristics, feature use, conversions, and service performance. Depending on your location, these technologies may require notice, consent, or an opt-out choice. You can also control many cookies through your browser or device settings.
9. Retention, Access Expiration, and Deletion
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy. Retention depends on the type and sensitivity of the information, the feature used, the length of our relationship, configured access periods, security and fraud risks, backup cycles, dispute needs, and legal, tax, accounting, or regulatory requirements.
The editing and download-access deadlines for an Instant Resume Session determine when the Guest User can use the session; they are not promises that every associated record is deleted at that exact time. After access expires, resume content, uploaded files, chat history, revisions, session records, logs, and backups may remain for a limited period for recovery where offered, security, fraud prevention, support, dispute resolution, legal compliance, and backup rotation. We delete or de-identify them when they are no longer reasonably needed for those purposes.
Transaction, refund, chargeback, tax, accounting, consent, Terms-acceptance, security, and fraud-prevention records may be retained longer than resume content where reasonably required. Aggregated or de-identified information may be retained when it no longer reasonably identifies an individual.
Deleting an Account or resume may not immediately remove all copies from backups, logs, transaction records, dispute records, payment records, public links already accessed by others, or records we must retain by law or for legitimate business purposes.
10. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No online service, storage system, transmission method, or AI system can be guaranteed completely secure.
Instant Resume session cookies, access links, and recovery links can provide access to personal resume information. Keep them private, use an email account you control, sign out of shared devices where supported, and notify us if you believe a credential or session has been compromised.
11. International Processing and Transfers
We operate a global service through a company incorporated in the United States. Your information may be processed and stored in the United States and in other countries where we or our providers operate. Data protection laws in those countries may differ from those in your place of residence.
Where required, we rely on recognized transfer mechanisms or safeguards, such as adequacy decisions, contractual protections, standard contractual clauses, or another lawful transfer basis. You may contact us for additional information about safeguards applicable to your information.
12. Your Choices and Privacy Rights
Depending on your location and subject to applicable exceptions, you may have rights to know or access personal information, correct inaccurate information, delete information, restrict or object to processing, withdraw consent, receive a portable copy, opt out of certain processing, appeal a denied request, or complain to a privacy regulator.
You may also be able to manage Account information, unpublish resumes, delete content, cancel subscriptions, change communication preferences, or request support through the Services. Guest Users may submit requests through [email protected] and may be asked to verify control of the email address associated with the Instant Resume Session.
We may need to verify your identity and authority before fulfilling a request. You may use an authorized agent where applicable law permits. Requests may be limited by legal, security, fraud prevention, payment, dispute, free-expression, or recordkeeping obligations. We will not unlawfully discriminate or retaliate against you for exercising a privacy right.
13. Regional Privacy Disclosures
Privacy rights and required disclosures vary by jurisdiction. The following provisions supplement the rest of this Policy and apply only where the relevant law applies:
European Economic Area, United Kingdom, and Switzerland: you may have rights of access, correction, erasure, restriction, portability, objection, and withdrawal of consent, and the right to complain to your local supervisory authority. Our legal bases and international-transfer practices are described above.
United States state privacy laws: residents of certain states may have rights to know, access, correct, delete, or obtain a portable copy of personal information; opt out of certain sales, sharing, targeted advertising, or profiling; limit certain uses of sensitive personal information; appeal a decision; and receive equal service, as applicable. Availability depends on the law and whether its thresholds and exceptions apply to us.
Other countries and regions: you may exercise locally available rights by contacting us. Where required, you may also complain to the competent data-protection or consumer authority in your jurisdiction.
14. Children
The Services are not intended for children under 18 or the age of legal majority in their jurisdiction. We do not knowingly collect personal information from children. If you believe a child has provided personal information, contact us so we can take appropriate action.
15. Changes, Controller Contact, and Complaints
We may update this Privacy Policy to reflect product, legal, operational, or business changes. We will update the effective date and provide additional notice or obtain consent for material changes where required by law.
MyResumeTool is the controller or equivalent responsible business for the processing described in this Policy unless a feature-specific notice identifies another entity. Questions, complaints, and privacy-rights requests may be directed through [email protected]. You may also complain to an applicable privacy or consumer authority, although we welcome the opportunity to address your concern first.
